End User License Agreement (EULA) Last Updated: May 16, 2025 This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("User" or "you") and Silv LLC ("Company," "we," "us," or "our") governing your use of Zone (the "Application"), a mobile application provided by us. By downloading, installing, or using the Application, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not download, install, or use the Application. 1. Eligibility To use the Application, you must be at least 17 years of age or older. By agreeing to this EULA, you represent and warrant that you are 13 years of age or older. If you are under 13, you are not permitted to use the Application. 2. License Grant Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application on a mobile device that you own or control, solely for your personal, non-commercial use. 3. User Content and Conduct 3.1 Content Restrictions: You agree not to upload, share, or distribute any content through the Application that: Is illegal, violent, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable; Infringes on the rights of others, including intellectual property rights, privacy rights, or publicity rights; Contains malware, viruses, or other harmful code. 3.2 Responsibility: You are solely responsible for any content you submit or share through the Application. We reserve the right, but are not obligated, to monitor, review, or remove any content at our discretion. 3.3 Location Data: By using the Application, you consent to our collection and use of your location data. We reserve the right to use this data to enforce the rules and terms of this EULA (e.g., to detect cheating or unauthorized use), as well as for sales and marketing purposes (e.g., to provide location-based offers or improve our services). You may disable location services through your device settings, but this may limit certain features of the Application. 4. Prohibited Activities You agree not to: Use the Application for any illegal or unauthorized purpose; Cheat, exploit, or use unapproved third-party software, tools, "GPS spoofers" or scripts to interact with the Application or our servers; Attempt to reverse-engineer, decompile, disassemble, or otherwise interfere with the Application’s functionality or security. 5. Enforcement and Consequences 5.1 Account Termination: If we determine, in our sole discretion, that you have violated this EULA—including cheating, using unapproved third-party software, or sharing prohibited content—we may take the following actions: Ban or suspend your account; Remove any content you have submitted; Disqualify you from participating or being awarded in contests, events, or other promotions offered through the Application. 5.2 No Refunds: Any actions taken under this section will not entitle you to a refund or compensation of any kind. 6. Ownership and Intellectual Property The Application and all associated content, including but not limited to text, graphics, logos, and software, are the property of Silv LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Application or its content without our prior written consent. 7. Termination We may terminate or suspend your access to the Application at any time, with or without cause or notice, including if we discontinue the Application or if you breach this EULA. Upon termination, your license to use the Application will immediately cease, and you must uninstall the Application from your device. 8. Disclaimer of Warranties The Application is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Application will be error-free, secure, or uninterrupted. 9. Limitation of Liability To the maximum extent permitted by law, Silv LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Application, even if we have been advised of the possibility of such damages. 10. Governing Law This EULA shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. 11. Changes to the EULA We may update this EULA from time to time. If we make material changes, we will notify you through the Application or by other means. Your continued use of the Application after such changes constitutes your acceptance of the updated EULA. 12.
